Assignment description:
The Government of the Republic of Moldova has received a loan from the Council of Europe Development Bank (CEB) in an amount of 39 000 000 EUR toward the cost of the Chisinau Penitentiary Program, and intends to apply a portion of the proceeds of this loan to eligible payments under this contract.
The contract award under this notice is conditional upon the Ministry of Justice obtaining the necessary additional funds and/or budget agreement before the latest date stated in the tender documents upon which the contract must be signed, or such later date as may be communicated to the consultants, failing which this tender will be considered cancelled. Should the conditions for the execution of the contract not be fulfilled in line with this suspensive clause, no contract will be awarded under this tender competition and the proposal submissions will be returned to the consultants. The Contracting Authority shall not be liable to the consultants for any expenses, or direct or consequential losses arising out of the cancellation of the selection process.
The objective of the construction supervision services is to supervise the execution of the works and administer the contract through efficient and effective expertise, resulting in the issue of a taking-over certificate and a performance certificate for the following works contract within the budget and time defined in the project procurement plan.
The Chisinau Penitentiary Project Implementation Unit (hereinafter referred to as the ‘Employer’) invites proposals from suitably qualified firms who are interested in providing such assistance to the employer to facilitate the timely and effective implementation of the project by advising the employer on the administration of the CEB funded works contract with due diligence and by carrying out the duties of the engineer assigned to him in the contract which will be a re-measurement unit rate contract based on FIDIC conditions of contract for construction, MDB Harmonized edition, 2010. The consultant shall exercise the authority attributable to the engineer, as specified in or necessarily implied from the contract, to ensure timely, satisfactory completion of the works in accordance with the contract.
Assignment start date and duration: The assignment is expected to start in November - December 2019 and last about 51 months, which includes 1 month for pre-commencement activities, 36 months of works supervision, or until acceptance of works, whichever is longer, 12 months covering defects notification period and 2 months for the performance certificate issue and other closing activities.
Funding source: CEB.
Estimated value excluding VAT: 700 000 EUR.
Eligibility: procurement will be open for all the consultants except those restricted in the world bank’s list of ineligible entities. The proceeds of the loan shall not be used for the purpose of any payment to persons or entities or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations and the client’s Country prohibitions, if such prohibitions are confirmed as acceptable by the Bank.
Type of procedure: open/fixed budget selection.
Procurement procedure: procurement of the consultancy services will be conducted in accordance with the CEB’s guidelines for procurement of supplies, works and services dated September, 2011.

Proposals must be delivered to the employer to the address mentioned below by 2.9.2019 at 10:00 (local time).
Proposals received after this time and date may be returned unopened.
