Oslo kommune ved Vann og avløpsetaten [Oslo Municipality c/o the Water and Sewage Authority] intends to sign a new contract with Drammen Havn [the Port of Drammen] for the delivery of tunnel rock from the New Oslo Water Supply project for the development of the Port of Drammen.

Oslo kommune ved Vann og avløpsetaten [Oslo Municipality c/o the Water and Sewage Authority] intends to sign a new contract with Drammen Havn [the Port of Drammen] for the delivery of tunnel rock from the New Oslo Water Supply project for the development of the Port of Drammen.

The delivery of tunnel rock is estimated to amount to approx. 4 500 000 tonne of clean fill.

Gunning van een opdracht zonder voorafgaande bekendmaking van een oproep tot mededinging in het Publicatieblad van de Europese Unie in onderstaande gevallen

The water and sewage authority's understanding is that the contract is not subject to Public Procurement Regulations cf. PPR § 3-3 [FOA § 3-3].

Regardless, the contract will not be subject to the Public Procurement Regulations as the Public Procurements Act § 2 determines that ‘the law applies when the contracting authorities stated in the second paragraphs sign goods, services or building and construction contracts, including concession contracts, or implement planning and design competitions, with an estimated value equal to or exceeding 100 000 NOK excluding VAT.’ The water and sewage authority supplies tunnel rock free of charge and there is therefore no payment for the tunnel rock from the water and sewage authority to the Port of Drammen. Therefore, the value of the procurement does not exceed 100 000 NOK and the procurement regulations do not apply.
