There are circumstances outside the contracting authority's control and which a diligent contracting authority could not have foreseen at the time the framework was entered into - namely, remodelling of services in NHS England including formation of provider collaboratives and the Transforming Care Agenda. The same providers deliver services to NHS Wales. The contracting authority is modifying the contract by extending the end date by 12 months from 31 March 2020 to 31 March 2021. The contracting authority is placing reliance upon Regulation 72(1)(c) of the Public Contracts Regulations 2015.
 
There is uncertainty in Mental Health service models commissioned by NHS England. NHS England are seeking to support people being treated close to home in clinically and cost effective services which has included block booking beds with providers. The same providers deliver services to NHS Wales and affected NHS Wales’ ability to place patients when required. NHS England are reviewing different service models, but no agreement has yet been finalised.
